Terms & Conditions

1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and ChromaCoat Pro (“we,” “us,” or “our”), concerning your access to and use of the ChromaCoat Pro website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

2. Estimates and Proposals

All estimates are provided free of charge. The estimate is a proposal and not a contract. The price quoted is valid for 30 days from the date of the estimate. Acceptance of the proposal, either verbally or in writing, constitutes a contract for services. Estimates are based on the information provided by the client and an assessment of the work area. Any additional work requested or required will be quoted separately and will require client approval before proceeding.

3. Payment Terms

For most residential projects, payment is due in full upon completion of the work to the client's satisfaction. For larger projects (as defined in the proposal), a deposit of up to 50% may be required to secure a start date and cover material costs. The final balance is due upon project completion. We accept payment via check, credit card, or electronic bank transfer. A late fee may be applied to invoices not paid within 15 days of the due date.

4. Scheduling and Project Execution

We will provide an estimated start date and project duration. While we strive to meet these timelines, they are subject to change due to weather, unforeseen site conditions, or other factors beyond our control. The client is responsible for providing access to the property during the agreed-upon work hours. The client is also responsible for removing all small, fragile, and valuable items from the work area prior to our arrival.

5. Color Selections

The client is responsible for the final color selection. We can provide color consultations and swatches to assist in this process. Once colors are selected and paint is purchased, any changes to the color selection may incur additional costs for new materials and labor. We are not responsible for color choices that the client is unsatisfied with after application, provided they match the selected color code.

6. Warranty

We provide a written warranty covering our workmanship for a period of two (2) years from the date of project completion. This warranty covers peeling, blistering, or chipping paint resulting from defective workmanship. This warranty does not cover damage caused by abuse, normal wear and tear, moisture intrusion, or pre-existing structural defects. Full details of the warranty will be provided with the contract.

7. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our services, even if we have been advised of the possibility of such damages.

8. Governing Law

These Terms shall be governed by and defined following the laws of the state in which the service is performed, without regard to its conflict of law principles. You and ChromaCoat Pro irrevocably consent that the courts of said state shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
